Compliance requirements
The successful bidder, and every member of a joint tender where applicable, will be checked for exclusion grounds. Bidders must confirm that none of the grounds listed in sections 95(1)(1)–(3) and (5) of the Estonian Public Procurement Act, taking account of section 95(2), applies; that they are not bankrupt, being wound up, subject to insolvency or liquidation proceedings, have suspended business, or are in an equivalent situation under the law of their country; and that they have no outstanding taxes, duties, environmental charges, or social security contributions under the applicable national law.
The bidder must also confirm that, during the reference period, its employees’ average wages exceeded 70% of the average wage for the same period in the field relevant to the contract. The reference period is six calendar months, ending in the month two months before the calendar month in which the procurement procedure began. Evidence must be provided from the Estonian Tax and Customs Board, or from an equivalent competent authority in the case of a foreign bidder. In a joint tender, each member must provide evidence.
The bidder must confirm that it is not a related party of the technical consultant advising the beneficiary on the apartment building’s reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general construction, indoor climate systems, and building-internal or associated water supply and sewerage systems. Where electrical work is performed, the bidder must also be registered for construction and installation of electrical installations. A foreign bidder may provide evidence of equivalent competence.
The bidder’s net turnover in the financial year preceding the start of the procurement procedure must be at least twice the estimated contract value excluding VAT. The bidder must confirm that it can provide a performance-period guarantee equal to 5% of the contract price no later than the contract signing date or within 10 calendar days after signing. The guarantee must remain valid throughout the construction period. Depositing the relevant amount in the beneficiary’s bank account or a notary’s account is also acceptable, provided the beneficiary remains entitled to it throughout the construction period. Joint bidders may provide the guarantee jointly.
During the 60 months preceding the start of the procurement procedure, the bidder must have completed at least one equivalent building project as main contractor, involving construction, extension, or full-building reconstruction, with a value of at least half the estimated contract value excluding VAT. The work must have included construction or reconstruction of the building’s load-bearing structures and external envelope, heat-recovery mechanical ventilation, and a new heating system. The bidder must provide project details, dates, value, and a description demonstrating that all these conditions were met.
The element manufacturer engaged by the bidder must, during the preceding 60 months, have manufactured façade or roof reconstruction elements for at least three equivalent existing or new buildings. The manufacturer’s principal business must be the production of prefabricated wooden buildings and their elements. An equivalent building is at least three storeys high, has an indoor climate system, and uses prefabricated elements. If the apartment building being procured is under three storeys, a building with the same number of storeys is considered equivalent. Details of three projects must be provided, including the building and its number of storeys, the date the elements were completed, and whether façade or roof elements were produced.
The team must include the following qualified personnel. Foreign bidders may provide personnel with equivalent qualifications:
- Project manager: Construction Engineer, level 6, specialised in building construction with competence in managing construction activities, or Construction Manager, level 6, specialised in general construction.
- Site manager: Construction Works Supervisor, level 5, with comprehensive specialisation in general construction works.
- Ventilation and heating systems specialist: Heating, Ventilation and Cooling Engineer, level 6, competent to manage construction of heating and ventilation systems, or Construction Manager, level 6, specialised in indoor climate systems.
- Water supply and sewerage systems specialist: Water Supply and Sewerage Engineer, level 6, competent to manage construction activities, or Construction Manager, level 6, specialised in building-internal or associated water supply and sewerage systems.
- Electrical works personnel: at least a B-class competence certificate, or an Electrical Engineer, level 6, in consumer electrical installations.
- Person responsible for the building design’s compliance with the New European Bauhaus requirements: authorised architect, level 7.
The bidder must provide each person’s name and professional or competence certificate number.
The bidder must have quality and environmental management systems in the construction field meeting at least EVS-EN ISO 9001 and EVS-EN ISO 14001, respectively, or equivalent requirements. If a certificate cannot be verified through the Estonian Association for Quality database, the bidder must, on request, provide a valid certificate copy or other relevant evidence.
The tender must be submitted using the beneficiary’s form, be unconditional, and comply with the procurement documents. For a joint tender, the power of attorney must state the size and nature of each member’s share of the contract; joint bidders are jointly and severally liable for performance. The tender must be submitted by a statutory or authorised representative; an authorisation document must be included when submitted by an authorised representative. Claims of equivalence must be supported by evidence. If team members who are not employees of the bidder or a joint bidder are relied upon to demonstrate competence, written consent to their participation must be provided for each person. Any trade secret must be identified and its designation justified. The provided documents do not specify the award criteria; these should be checked in the tender documents.
