Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded for convictions within the previous five years, or an exclusion period still in force, involving participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, court- or liquidator-managed assets or suspended business; serious professional misconduct; competition-distorting agreements; unresolvable conflicts of interest; involvement in preparing the procurement where an advantage cannot otherwise be remedied; serious or repeated failures under previous contracts; and false or misleading information, withholding information, failure to provide requested documents or improperly obtaining confidential information. Additional national grounds cover enabling the unlawful employment of a foreign national, international sanctions, and tax offences. The bidder must also confirm that neither it nor any entity whose qualifications it relies on is established in Russia or Belarus. Where an exclusion ground applies, remedial measures may be presented if the procurement is above the international threshold or the tender documents allow this. The notice states a zero threshold for tax and social-security arrears; under Estonian tax rules, a tax-debt certificate is not issued for debts below EUR 100 or where payment has been rescheduled.

Qualification criteria and exclusion grounds

The bidder must have had annual net turnover of at least EUR 500,000 in each of the three financial years completed by the start of the procurement. If the financial year follows the calendar year, the required years are 2025, 2024 and 2023. During the 60 months before publication of the contract notice, the bidder must have properly completed at least two similar construction contracts. The bidder may have acted as main contractor or subcontractor. Each contract must include façade works and at least 2,500 m² of tile or cassette façade work on a building or building complex. Provide a list of contracts with the client’s name and contact details, description and volume of the works, contract period and, where applicable, the procurement reference number. At the contracting authority’s request, provide the client’s confirmation that the works were properly performed. Reliance on another entity’s experience is permitted only where its resources are necessary for contract performance and that entity personally performs the relevant part of the contract; a procurement passport must also be provided for that entity. The construction works manager responsible for the works must hold at least the professional qualification “Construction Works Manager, Level 5”, specialising in “General Construction Works”. A qualification in construction management or an initial qualification awarded by an educational institution is not considered equivalent. Evidence of qualifications issued outside Estonia must be submitted with the tender. The tender must accept the conditions in the procurement documents and include the participation application in Form 2, including subcontractor details. Prices must be stated in euros both on the procurement register’s price sheet and in a fully completed Form 3. If the amounts differ, the VAT-exclusive total in Form 3 prevails. The works manager’s details must be provided in Form 4. Documents designated as trade secrets must be identifiable, listed separately and accompanied by reasons for their designation. Where several bidders submit a joint tender, Form 8 must appoint their representative and confirm joint and several liability. The bidder must confirm that its tender complies with the procurement documents; any equivalent solution must be explained and supported by evidence.
