Compliance requirements
The bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, an authorised representative or another person empowered to represent, make decisions for or control the bidder, has been convicted of participation in a criminal organisation, breach of professional integrity or a corrupt act, fraud, a terrorist act or another terrorism-related offence, money laundering or terrorist financing. The grounds also include convictions for enabling a foreign national to work while unlawfully present in the country, or for breaches of the conditions for employing foreign nationals, including paying less than the legally required wage; and convictions relating to unlawful child labour or human trafficking. Exclusion also applies where the bidder has outstanding national taxes, duties or environmental charges, tax or social-security contribution arrears under the law of its country of establishment, or where awarding the contract would breach an international sanction or a sanction imposed by the Estonian Government. The bidder must confirm that none of these grounds applies.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment where required by that country's law and provide evidence of registration. A bidder established in Estonia does not need to submit a copy of its registration document.
During the 60 months before the procurement began, the bidder and/or its subcontractor must have properly completed at least one similar contract involving the repair, restoration, reconstruction or construction of concrete or reinforced-concrete structures. The contract must have included placing and finishing concrete on an existing structure or part of one. The works must have been completed and accepted by the client. The bidder must submit a list of contracts stating each contract's name, brief description, performance period and other contracting party. If the bidder relies on a subcontractor's experience, that subcontractor must be identified in the subcontractor list.
The bidder and/or its subcontractor must provide at least one qualified person responsible for managing the works, holding a valid Construction Works Manager, Level 5, and/or Road Engineer, Level 6, professional qualification, or an equivalent or higher qualification. The bidder must provide a list of responsible specialists and copies of documents proving their qualifications and competence. Evidence of qualifications obtained abroad must be included with the tender. If Estonian law requires recognition of a foreign professional qualification or notification of temporary service provision before the works begin, the bidder must ensure that this requirement is met.
Subcontracting is permitted. The bidder must state the size and nature of the contract portion to be performed by subcontractors and provide a list of subcontractors. Joint bidders must appoint an authorised representative from among themselves and submit the authorisation.
The tender must be unconditional, and the bidder must confirm acceptance of the tender-document requirements. The price must follow the specified structure, with all yellow-highlighted blank cells in the tender form completed; rows may not be deleted. The bidder must provide documents, lists or product passports confirming the types and technical characteristics of the proposed materials and equipment. If an equivalent solution is offered, its equivalence must be explained and supported by evidence.
The bidder must identify and justify any information claimed as a trade secret. The tender price and figures relating to the award criteria may not be designated as trade secrets. The bidder must disclose circumstances that could give rise to a conflict of interest or distort competition, including any potential competitive advantage gained through the bidder's or a related person's involvement in preparing the procurement, and describe those circumstances. The bidder must also confirm that it is not aware of any conflict of interest or competitive advantage.
