Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if the bidder or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of the duty of honesty, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the unlawful employment of a foreign national or violating the conditions for their employment in Estonia, including paying below the statutory wage rate; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has overdue national taxes, duties or environmental charges, or tax or social security contributions under the law of its country of establishment, or where awarding the contract would breach an international or Estonian government sanctions measure. The bidder must confirm that none of these grounds applies.

Qualification criteria and exclusion grounds

The bidder must be entered in the commercial register of its country of establishment where required by that country’s law. It must provide evidence of registration, except that a bidder established in Estonia does not have to submit a copy of its commercial register record. The bid must comply with all tender-document conditions and be unconditional. The price must follow the buyer’s prescribed structure, and all yellow-highlighted blank cells in the bid form must be completed; rows may not be deleted from the table. The bidder must identify any trade secrets in its bid and explain why the information qualifies as a trade secret. The bid price and figures corresponding to award criteria may not be classified as trade secrets. The bidder must disclose circumstances that could cause a conflict of interest or create a competitive advantage. If the bidder or a related person took part in preparing the procurement, or if another potential conflict or advantage exists, the bid must include a free-form explanation identifying the person concerned, the nature of the connection, and any information received or other relevant circumstances. The supplied document text does not specify the detailed award-criteria weights or evaluation rules.
