Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if it, or a person empowered to represent, manage or control it, has relevant convictions for participation in a criminal organisation, corruption or breach of integrity, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, or enabling the unlawful employment of foreign nationals. Exclusion also applies to tax, environmental charge or social security contribution arrears and where awarding the contract would breach an international or Estonian government sanction. The contracting authority may also exclude a bidder for serious or persistent breach of an earlier public contract, or for false information or failure to provide requested information or documents. The bidder must submit the declarations on Annex 5; in a joint tender, each member must submit the applicable declarations. The authority checks mandatory exclusion grounds for named first-tier subcontractors and subcontractors added during contract performance; subcontractors in further tiers are not checked under the stated arrangements.

Qualification criteria and exclusion grounds

All requirements apply to every lot. - The bidder must be registered in the business register of its country of establishment if required by that country’s law. The country must be an EU or EEA member state, or a party to the WTO Government Procurement Agreement. Upon request, the bidder must provide a valid registration certificate; this is not required from bidders established in Estonia. - The bidder’s aggregate net turnover for the last three financial years completed by the start of the procurement (2023, 2024 and 2025) must be at least EUR 6,000,000 excluding VAT. If the bidder’s financial year does not run from 1 January to 31 December, turnover figures for its corresponding financial-year periods must be provided. Turnover must be reported on Annex 5; upon request, the bidder must provide an extract from its annual report or other evidence. - During the 60 months preceding the start of the procurement, the bidder must have completed at least one contract involving construction and/or major repair works on a public railway, covering at least 5,000 metres in total. The works must have been accepted and performed without material breaches. An ongoing contract may also count if it meets these conditions. Contract details must be provided on Annex 5 and, upon request, supported by confirmation from the client. - The bidder must have access, through the end of the contract, to a tamping and lining machine, a ballast regulator and a UK track-laying crane. The equipment may be owned by the bidder or available under a binding agreement. For each item, provide technical details, including work capacity, and state whether it is owned or available under an agreement. The contracting authority may request evidence of the right to use the equipment. - The bidder must have implemented a quality management system compliant with EVS-EN ISO 9001 or an equivalent system, and an environmental management system compliant with EVS-EN ISO 14001 or an equivalent system. Provide the relevant details on Annex 5; the authority may request copies of certificates or other evidence. Equivalence may, for example, be confirmed by an independent audit firm or an accredited certifier. - If the bidder relies on another entity’s resources to demonstrate economic, financial, technical or professional capacity, it must provide that entity’s details on Annex 5 and its declaration on Annex 5.1. - The tender must include the participation declaration on Annex 2 and comply with the procurement documents; conditional tenders are not permitted. Any claimed equivalence must be explained and supported by evidence. - Prices must be stated in euros in the required structure and on Annex 7, with all required fields completed. The pricing form must not be altered or annotated. If a unit price conflicts with the calculated total, the unit price prevails. If the amount in the procurement portal differs from the pricing form, the VAT-exclusive total calculated from the pricing form prevails. - For a joint tender, submit the power of attorney on Annex 4, signed by all members; the members must appoint an authorised representative and confirm joint and several liability. The tender must identify any confidential business information and explain why it is confidential, or state that it contains none. - The notice and documents provided do not specify the precise award-criterion weightings or scoring method.
