Compliance requirements
The bidder may be excluded if it, or a member of its administrative, management or supervisory body or another person authorised to represent, direct or control it, has a relevant final conviction within the past five years, or remains subject to an exclusion period. The listed offences include participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. Where legally available under the applicable procurement thresholds or tender documents, the bidder may provide evidence of measures taken to restore its reliability.
Exclusion grounds also include unpaid taxes or social security contributions in the country of establishment or the contracting authority’s country, enabling work by a foreign national who is staying unlawfully or breaches of the conditions for employing a foreign national in Estonia, and circumstances in which awarding the contract would violate an international or Estonian government sanction. The notice sets the threshold for tax and social security arrears at EUR 0. It explains that, under Estonian rules, a tax-debt certificate is not issued where the relevant tax debt is below EUR 100, excluding interest not established by an administrative act, or where payment of the debt has been rescheduled; foreign bidders are assessed under the rules of their country of establishment.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least one similar contract during the three years preceding the procurement procedure. A similar contract is for personal assistant, support person, home care or counselling services for people with disabilities, covering at least 1,000 hours per year. The bidder must provide a list of completed contracts with information about the contract subject and the other parties; the tender-pass information also requests details such as the contract value, dates and contracting party.
The bidder must confirm that it has enough personal assistants available to arrange replacements when an assistant is temporarily unable to work. The tender documents request information on the assistants’ experience and the number of assistants included or to be included in the bidder’s team, using Appendix 3, Form 1; no specific minimum team size or experience threshold for individual assistants is stated in the provided text.
For a joint bid, the participants must appoint an authorised representative and provide the authorisation. The bidder must identify any information in its tender that it considers a trade secret and explain why; the tender price and other numerical figures used to evaluate service tenders may not be designated as trade secrets. The bidder must confirm acceptance of the contract notice and tender-document conditions and the contract terms in the relevant annex. The offered price must account for possible cost increases and include all costs of preparing and submitting the tender and performing the contract; it must not be conditional or subject to inflation or exchange-rate changes.
