Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded if it, or a person with authority to represent, manage or control it, has a final conviction within the previous five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, unlawful use of child labour or human trafficking, or remains subject to an exclusion period imposed by a judgment. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. Exclusion also applies to outstanding tax or social security contribution obligations. The stated threshold is EUR 0; under Estonian rules, however, the tax authority does not issue a tax-debt certificate where the debt is below EUR 100 or payment has been deferred. Other grounds include enabling a foreign national without a legal basis to work, a contract award that would breach an international or Estonian government sanction, and any restriction on the bidder’s right to participate based on its place of establishment or residence.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register where required by the laws of its country of establishment. An Estonian bidder does not need to submit separate proof of registration. A foreign bidder must provide a valid copy of its registration certificate if the contracting entity does not have free access to the relevant register. The bidder’s turnover from cleaning services over the three most recently completed financial years must total at least EUR 1,200,000. The bidder must demonstrate properly performed service experience during the three most recently completed financial years. At least one relevant assignment is required, covering both indoor and outdoor cleaning. The outdoor cleaning experience must include work in the railway safety zone, including cleaning railway crossings and passenger platforms and snow clearance. The bidder must provide a description of the work, its value and period, and the client and contact person’s details. If subcontracting exceeds 10% of the bid price, or the bidder relies on a subcontractor to meet qualification or compliance requirements, the relevant subcontractor’s ESPD must be submitted. The bidder must state the approximate share and work areas planned for subcontracting; changes to subcontracting must be agreed with the contracting entity. Joint bidders must appoint an authorised representative, accept joint and several liability for contract performance, and submit a power of attorney using the contracting entity’s form. Conditional bids are not permitted. Staff cleaning railway crossings and carrying out snow clearance must hold the Railway Track Mechanic Assistant, Level 2 qualification; for qualifications issued before 12 April 2023, the Level 2 sub-qualification for cleaning crossings and level crossings is also accepted. Before work begins, the contractor must provide the qualification details of staff who clean crossings. Everyone working in the railway safety zone must complete safety instruction and comply with the client’s safety rules. The bidder must submit the completed pricing table in the contracting entity’s form, with unit prices, and state the total price for the 36-month service period, calculated as the annual price multiplied by three.
