Compliance requirements
The bidder must confirm that neither it nor its representatives or members of its management or supervisory bodies are subject to grounds for exclusion. These include final convictions within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal child labour or human trafficking. Other grounds may include unpaid taxes or social-security contributions; bankruptcy or insolvency; liquidation or suspended business activities; serious professional misconduct; anti-competitive agreements; conflicts of interest; an unfair advantage arising from involvement in preparing the procurement; material breach of a previous contract; misrepresentation or failure to provide required information or documents; and breaches of environmental, social or labour-law obligations.
National grounds also include enabling a foreign national without a lawful basis to stay in Estonia to work, or breaching the conditions for a foreign national’s work in Estonia, including paying less than the prescribed wage; violating international or Estonian sanctions; a conviction for a tax offence; and being ineligible to bid because of a restriction based on the bidder’s place of establishment or residence. Where permitted for the relevant ground, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The European Single Procurement Document does not set specific turnover, previous-experience or staff-qualification thresholds. The bidder must submit technical descriptions of the products and Estonian- or English-language product information that enables the contracting authority to verify their characteristics and compliance. The bid must comply with the procurement documents; conditional bids are not permitted, and prices must follow the prescribed structure. If an equivalent product is offered, the bidder must explain its equivalence and provide supporting evidence.
The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned territories. Subcontractors and suppliers used to perform the contract must be established or resident in Estonia, another EU Member State, an EEA contracting state or a WTO member bound by the Government Procurement Agreement. Subcontractors or suppliers that are Russian nationals, residents or entities established in Russia—or entities owned or directed by them—must not account for more than 10% of the contract value. For a joint bid, an authorisation appointing a representative for the group must be submitted. The bidder must also identify any persons authorised to represent, make decisions for or control it who are not shown in the commercial register, or confirm that there are no such persons.
