Compliance requirements
The tender passport asks the bidder to declare whether exclusion grounds apply to the bidder or relevant representatives. These include convictions within the past five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking; unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspended business activity or comparable circumstances; serious professional misconduct; anti-competitive agreements; conflicts of interest; involvement in preparing the procurement where this creates an unavoidable competitive advantage; serious or repeated breaches of previous contracts resulting in early termination, damages or comparable sanctions; false or misleading information, failure to provide required information or documents, or improper attempts to obtain confidential information. National grounds also include enabling unlawful employment of a foreign national, being subject to an international sanction, tax-related convictions, and restrictions on eligibility to participate. For tax debts, the stated threshold is EUR 0; the notice explains that an Estonian tax-debt certificate is not issued where the debt is below EUR 100 or payment has been rescheduled. Where applicable, the bidder may describe remedial measures to demonstrate reliability; this possibility applies where the procurement exceeds the international threshold or the tender documents provide for it.
