Compliance requirements
The bidder must confirm that neither it nor its relevant representatives have grounds for exclusion, including final convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The bidder must also declare whether it has breached tax or social security payment obligations. For tax debts, the stated threshold is EUR 0; the notice explains that a tax-debt certificate is not issued for a debt below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled.
Other grounds include breaches of environmental, social or labour-law obligations; bankruptcy, insolvency or liquidation proceedings, an arrangement with creditors, administration of assets by a liquidator or court, suspended business activity or a similar situation; serious professional misconduct; anti-competitive agreements; an unmanageable conflict of interest; involvement in preparing this procurement where the resulting competitive distortion cannot otherwise be avoided; serious or repeated failure to perform a previous contract resulting in early termination, damages, a price reduction or a penalty; and submitting false or misleading information, withholding required information or documents, or improperly seeking confidential information or influencing the contracting authority.
National grounds also include enabling a foreign national without a legal basis to work, being subject to an international sanction, and relevant tax offences. Where an exclusion ground applies, the bidder may provide information about measures taken to restore its reliability where the applicable rules allow this. First-tier subcontractors are checked for the specified exclusion grounds and must be replaced if the contracting authority requires it and the ground applies.
Qualification criteria and exclusion grounds
The bidder’s total net annual turnover must have been at least EUR 600,000 in each of the last three completed financial years. If the information is not available in a public database, the bidder must provide the relevant annual accounts or extracts upon request.
The works must be managed by a project manager and a site manager:
- The project manager must hold a level 7 certified construction engineer qualification, or equivalent, specialising in building construction and construction management. They must have at least five years of construction experience and, within the last five years, have managed similar works as the contractor’s project manager on at least two buildings or building complexes, each with more than 2,000 m² of closed net floor area.
- The site manager must hold either a level 6 construction engineer qualification, or equivalent, specialising in building construction and construction management, or a level 6 construction manager qualification, or equivalent, specialising in general construction. The bid must include both specialists’ CVs demonstrating the required experience. If a specialist is not directly employed by the bidder, their signed confirmation that they will participate in contract performance must also be included. The specialists named in the bid must be the same as those identified in the tender passport. The site manager must be present at the construction site throughout the working day while construction is underway.
A site visit to the place of contract performance is a prerequisite for submitting a bid. The bid must be in Estonian; documents in other languages must be accompanied by an Estonian translation. The price must follow the structure and form in Annex 2, be stated in euros both excluding and including VAT to two decimal places, and include all costs required to perform the contract. Every line in Annex 2 must be completed without changes, added conditions or blank entries; the total price in the annex must also be entered in the procurement register. Conditional bids are not permitted.
Joint bidders must appoint an authorised representative and submit the relevant power of attorney; they are jointly and severally liable for contract performance. If subcontractors are used, the bid must include information about them in the form in Annex 4 and a signed declaration for each subcontractor using Annex 5. The first-tier subcontractors are checked for exclusion grounds. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
