Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A tenderer may be excluded if it, or a person in its management, supervisory or representative bodies, has a relevant conviction within the last five years or remains subject to an exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, and the national grounds concerning enabling unlawful employment of foreign nationals or paying below the statutory wage. Exclusion may also apply for unpaid taxes or social security contributions, insolvency, bankruptcy, liquidation, suspended business, serious professional misconduct, competition-distorting agreements, an unresolved conflict of interest, involvement in preparing the procurement that creates an unavoidable competitive advantage, serious or repeated breach of an earlier contract, false or misleading information, failure to provide required information or documents, improper attempts to influence the procurement, or seeking confidential information for an undue advantage. The grounds also cover environmental, social and labour-law breaches, international sanctions, and convictions for tax offences. For tax-debt evidence, the notice notes that an Estonian tax authority does not issue a debt certificate where the relevant debt is below EUR 100 or payment has been deferred. Where permitted, a tenderer may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The tenderer and each joint tender participant must be registered in a business or equivalent register as required by the law of their country of establishment. If registration is not legally required, provide the articles of association or an equivalent document. Joint tenderers must appoint an authorised representative and submit the relevant power of attorney; a power of attorney for the person signing the tender is also required where that person is not authorised in the register. The tenderer must be an official reseller of the proposed equipment and have manufacturer authorisation to provide technical support in Estonia. Submit the manufacturer-issued document or documents proving this. The tenderer must confirm that, at the time of submission, its service team includes at least one service engineer based in Estonia who speaks and writes Estonian and has the skills and experience needed to maintain and repair the equipment. The tender must include completed technical tables 1 and 2 and, where applicable, table 3, stating the actual value of every parameter, as well as the added-value points table 4. Technical specifications and compliance must be supported by references to the relevant pages of the manufacturer's materials. Submit the manufacturer's product information, user manual, a description of the offered configuration, and the manufacturer's instructions for pre-cleaning endoscopes and connecting the equipment to electrical, water, drainage and ventilation systems. The equipment must be authorised for use in the EU and carry the proper CE marking. The table 1 device must be a medical device assessed under Directive 93/42/EEC or Regulation (EU) 2017/745; provide evidence of its risk class and electrical safety class. For devices in tables 2 and, where applicable, 3, demonstrate compliance with applicable EU requirements and CE marking. The table 1 device must comply with EVS-EN ISO 15883-1:2025 and EVS-EN ISO 15883-4:2018, or equivalent standards; provide the manufacturer's declaration of conformity or a copy of an ISO certificate. The equipment must be new and unused, not a demonstration or refurbished unit, and no more than 12 months may have elapsed since manufacture by the time of delivery. The manufacturer's and supplier's warranty for the device must be at least 12 months, and the warranty for spare parts at least 6 months. Submit the warranty terms, the manufacturer's maintenance requirements and description of maintenance work, and price lists valid throughout the framework agreement for repairs and call-outs, reusable consumables, and single-use consumables. The tenderer must inspect the installation site and state any additional conditions the hospital must provide before installation, including requirements for the electrical system, water and drainage connections, indoor climate, ventilation, and access openings and lifts needed to transport the equipment. The tenderer bears the cost of any alterations needed to meet those requirements. The tenderer must allow the buyer to inspect the offered equipment if requested. The price offer must include delivery, installation, configuration and training costs and use the form specified in the tender documents. The tender must remain valid for at least 3 months from the submission deadline. The tenderer must state the planned subcontracting share, the subcontractors' names, and the nature and extent of their work. Subcontractors or suppliers with the specified Russian connection may not account for more than 10% of the contract value. The tenderer must also confirm that the goods offered are not subject to international sanctions and do not originate in sanctioned regions. The tender must identify and explain any claimed business secrets; the tender price and figures relevant to evaluation may not be treated as business secrets. Any equivalent solution must be explained and supported by evidence. The extracted compliance requirements require submission of the added-value points table but do not state the exact award-criterion weightings or scoring method.
