Compliance requirements
The bidder may be excluded for relevant final convictions involving organised crime, corruption, fraud, terrorism, money laundering or terrorist financing, human trafficking or child labour, and for failure to pay taxes or social security contributions. Other grounds include breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation or suspension of business; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest or unfair involvement in preparing the procurement; serious or persistent failures under previous contracts; false or withheld information, failure to provide requested evidence, or attempts to obtain confidential information or influence the decision improperly. National grounds also cover enabling the unlawful employment of a foreign national, being subject to an international sanction, and certain tax offences. The bidder must confirm that neither it nor its subcontractors or relied-upon entities are established in Russia or Belarus, and that the offered goods are not subject to international sanctions or from sanctioned regions. First-tier subcontractors are checked for applicable exclusion grounds. Where a ground applies, the bidder may provide information about remedial measures restoring its reliability where permitted.
Qualification criteria and exclusion grounds
For all five lots, the bidder must be entered in the relevant business register in its country of establishment. The bidder must also hold an Estonian Register of Economic Activities notice for electrical works, covering construction and installation of electrical installations. For each lot, the bidder must demonstrate at least two street-lighting construction or reconstruction projects completed and accepted by the client during the 60 months preceding the procurement. Project details must be provided in the ESPD; client-issued evidence that the works were properly performed must be supplied at the contracting authority’s request. The bidder must submit an unconditional tender accepting all procurement-document requirements, provide the price in the required structure, and confirm that it will not use a subcontractor who must be replaced on exclusion grounds. If relying on an equivalent product or solution, the bidder must explain and document its equivalence. For a joint tender, the partners must appoint an authorised representative and include their power of attorney.
