Compliance requirements
The bidder may be excluded if it has failed to meet its tax payment obligations in its country of establishment or, where different, in the contracting authority’s Member State. The contracting authority will check public registers; a foreign bidder must provide the relevant information on request. A bidder may also be excluded if insolvency proceedings have been initiated against it. The contracting authority will check public registers and may request the relevant information from a foreign bidder.
Qualification criteria and exclusion grounds
The bidder’s average annual sales revenue for the three financial years preceding publication of the procurement (2023–2025) must be at least EUR 300,000 per year. A bidder established outside Estonia must be prepared to provide signed copies of its annual accounts or equivalent documents as evidence.
Within the 60 months preceding the tender submission deadline, the bidder must have duly completed at least one building construction or reconstruction contract. The building, or the part constructed, must have a building footprint of at least 750 m². Eligible projects include agricultural production or storage buildings and other non-residential buildings of comparable construction volume. The works must have been accepted by the client. Provide the project name and location, a brief description of the works, the building footprint, completion date, and the client’s name and contact details. The contracting authority may request the client’s confirmation of proper completion.
The works must be managed by two different people:
- The construction project manager must hold a non-initial Level 7 (EQF 7) diploma-level civil engineering qualification and, during the 60 months before publication of the contract notice, must have managed as project manager the construction of at least one building, part of a building or building complex with a closed net floor area of at least 1,000 m².
- The site manager must hold a non-initial Level 6 (EQF 6) construction manager or civil engineer qualification and, during the same 60-month period, must have managed as project manager or site manager the construction of at least one building, part of a building or building complex with a closed net floor area of at least 1,000 m².
The contracting authority will check qualifications through Estonia’s professional register. If a qualification cannot be verified there, the bidder must provide evidence on request. For personnel qualified abroad, provide a copy of the relevant licence or professional certificate, or other evidence of the right to perform the work under the laws of the person’s country of establishment; equivalent qualifications may be supported by equivalent evidence.
The bid must follow the required price structure and use Form 1, Price Offer, together with the structure provided for evaluation criteria and priceable indicators. The price must account for the services and quantities needed to achieve the contracting authority’s stated objective. Conditional bids are not permitted. Where bidders submit a joint bid, they must appoint an authorised representative and include the joint bidders’ power of attorney (Form 2). The bidder must confirm compliance with the tender documents and provide explanations and evidence of equivalence where needed. Any information claimed as a trade secret must be identified and justified; the bid price and other evaluation-related indicators may not be designated as trade secrets.
