Compliance requirements
The exclusion grounds cover final convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. They also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation or similar proceedings; suspension of business; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot otherwise be resolved; involvement in preparing the procurement where an resulting advantage cannot otherwise be prevented; serious or repeated failures under previous contracts leading to early termination, damages or comparable sanctions; and false or misleading information, failure to provide required information or documents, or improper attempts to obtain confidential information or influence the procedure. National grounds also cover enabling the unlawful employment of a foreign national, contracting with a person subject to international sanctions, and convictions for tax offences. The bidder must declare whether any ground applies and provide details where relevant. For tax and social-security arrears, the stated threshold is zero euros; the notice explains that Estonian tax-debt evidence is not issued where the total debt, excluding interest not established by an administrative act, is below EUR 100 or payment has been deferred. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The tender is divided into 17 lots, and a bidder may submit offers for up to 17 lots. The offered products must meet the relevant product descriptions in Annex 1. Submit the completed technical offer in the required format, together with manufacturer-issued product specifications, instructions for use and other Estonian- or English-language materials demonstrating compliance. Explain any manufacturer-specific terminology. Products must be lawfully marketed under Regulation (EU) 2017/745 or its transitional provisions and bear the CE marking. Provide copies of the declarations of conformity and, where applicable, EC certificates; clearly identify the products offered if the documents cover other products as well. The bidder must hold the right to sell the offered products in Estonia and provide evidence from the manufacturer or, where applicable, its authorised representative; provide further authorisation documents where the authority was passed on. Submit the participation application using the required form. Joint bidders must appoint an authorised representative and provide the required power of attorney and confirmation of joint and several liability. Submit the price in euros, excluding VAT, in the prescribed format; it must include delivery and unloading at the Tartu University Hospital Surgery Clinic, L. Puusepa 8, Tartu, and relevant training, with no additional charges. Conditional offers are not permitted. Where an equivalent product or evidence is offered, explain and substantiate its equivalence. The specific product characteristics are set out in the tender documents.
