Compliance requirements
A bidder may be excluded where the bidder or a relevant representative has a qualifying conviction, within the preceding five years or while an exclusion period remains in force, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The grounds also cover unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspension of business or similar situations; serious professional misconduct; breaches of environmental, social or labour obligations; agreements intended to distort competition; unresolved conflicts of interest or involvement in preparing the procurement that creates an unremedied competitive advantage; and serious or repeated failure under previous contracts, including early termination, damages or comparable sanctions. Exclusion may also apply for false or misleading information, failure to provide required information or documents, or attempts to improperly influence the procurement or obtain confidential information.
National grounds include enabling a person without legal grounds to work or breaching rules on foreign workers, being subject to an international sanction, and relevant tax offences. A tax or social-security debt is assessed under the applicable rules; the notice states a threshold of EUR 0, while noting that Estonian tax authorities do not issue a debt certificate for debts below EUR 100 or where payment has been deferred. Where legally available, a bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 300,000 in each of the two financial years completed before the procurement began. If the financial year coincides with the calendar year, the relevant years are 2024 and 2025. The bidder must also have completed at least one similar contract worth more than EUR 200,000 during the 36 months before the contract notice was published. A similar contract is a furniture sale, rental or leasing transaction that also included furniture installation. The bidder must provide a list of the contract or contracts, including the contracting parties and their contact details, subject matter, value and term; for public procurement contracts, the procurement reference number must also be stated.
The bid must accept the conditions in the procurement documents and include the participation application (Form 2), the price table (Form 3) and product specifications (Form 9). Prices must be stated in euros both in the procurement register and in Form 3; if the totals differ, the amount calculated from Form 3 applies. Any documents identified as trade secrets must be marked and listed separately with reasons.
The furniture must have a warranty of at least 5 years from handover, covering repairs and a replacement product during repairs, without extra charges. Compatible spare parts or functionally equivalent components must be available for at least 5 years after handover, and contact details for obtaining them must be provided. Clear dismantling and repair instructions must be supplied with the furniture, including identification of removable and replaceable parts; the furniture must be dismantlable and repairable with ordinary hand tools by an untrained person.
The bidder must declare any REACH Candidate List substances present above 0.1% by weight in the product or any component or material, or confirm that none are present above that threshold. All wood and wood-based materials must come from legal sources. Evidence may include FSC, PEFC, CSA or SFI certification, equivalent evidence, or, where applicable, a FLEGT or CITES licence. For uncertified wood, the bidder must state the species, quantities and origin and confirm legality; traceability must be maintained from the forest to the finished product.
The bid must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. Restrictions also apply to Russian- or Belarusian-based bidders and entities relied on for qualification. The bidder must not involve, for more than 10% of the contract value, specified Russian-linked subcontractors, suppliers or relied-upon entities. For a joint bid, the participants must appoint a representative and provide a power of attorney and confirmation of joint and several liability (Form 8). Any stated technical references may be met by equivalent solutions, supported by appropriate evidence where needed.
