Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; unlawful employment of a foreign national or enabling breaches of the rules governing a foreign national’s work in Estonia, including payment below the statutory wage rate; or unlawful use of child labour or human trafficking. A bidder must also be excluded for outstanding national tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, and where awarding the contract would breach an international or Estonian government sanction. The contracting authority may exclude a bidder that has materially or repeatedly breached an essential term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has provided false information or failed to provide information or requested supporting documents concerning exclusion grounds or qualification. The bidder must submit the required confirmation using Appendix 5. For a joint tender, each member must provide the applicable confirmations.

Qualification criteria and exclusion grounds

The bidder must be registered in a business register in an EU Member State, an EEA contracting state or a state that is a party (not merely an observer) to the WTO Government Procurement Agreement, where registration is required by the law of the bidder’s country of establishment. At the contracting authority’s request, the bidder must provide a valid registration certificate; a bidder established in Estonia is not required to provide one. At least one planner and one architect must be assigned to perform the contract. One person may fill both roles if they meet the requirements for each. The planner must have higher education at master’s level in geography, architecture or landscape architecture, or a responsible specialist-level professional certificate, or a spatial planner professional qualification, or an equivalent qualification. During the five years preceding the start of the procurement, the planner must have prepared at least three detailed spatial plans that, by the time tenders are submitted, have been approved or have at least reached the adoption stage. The architect must hold at least a level 7 authorised architect professional certificate or an equivalent qualification. The bidder must provide the team list and experience using Appendix 7 and, where necessary, documents proving education or professional qualifications. If a foreign-issued professional certificate requires recognition in Estonia, the recognition procedure must be completed; if it is still pending when the tender is submitted, evidence that an application has been made to the competent Estonian authority must be provided. The certificate or its recognition must remain valid throughout contract performance. If a team member is not employed by the bidder, the bidder must provide that person’s confirmation, using Appendix 5.1, of the absence of exclusion grounds and of their availability and ability to participate in contract performance. The tender must include the participation declaration using Appendix 2 and the price in euros, following the structure specified for the procurement. It must comply with the tender documents; any proposed equivalent must be explained and supported by evidence of equivalence. The bidder must confirm that awarding the contract would not breach an international or Estonian government sanction and, if requested, provide supporting evidence. Joint bidders must submit an authorisation using Appendix 4, signed by all members, appoint an authorised representative and confirm joint and several liability. The bidder must identify and justify any information it considers a trade secret, or state that the tender contains no trade secrets. The planner’s experience is used in evaluation if it was gained in Tallinn. The detailed evaluation rules must be checked in the tender documents.
