Compliance requirements

The contracting authority will exclude a bidder if the bidder, a member of its administrative, management or supervisory body, or another person authorised to represent or control it has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the illegal employment of foreign nationals or breaches of their employment conditions, including payment below the statutory wage rate; or illegal child labour or human trafficking. Exclusion also applies where the bidder has outstanding taxes, fees or environmental charges, or social security contributions under the applicable law, or where awarding the contract would breach an international or Estonian government sanction. The bidder must confirm that none of these grounds applies.

Qualification criteria and exclusion grounds

The bidder must be entered in the business register of its country of establishment if registration is required by that country's law. A bidder established in Estonia does not need to submit a separate copy of its registry record. The bidder must submit its offer in the required structure, complete all applicable fields in Form 1 (Offer Form), and confirm that it accepts all tender conditions. Conditional offers are not permitted. If submitting a joint offer, the bidders must appoint an authorised representative and include the relevant power of attorney. Any claimed trade secret must be identified and justified; the offer price and other specified evaluation-related figures may not be classified as trade secrets. Where an equivalent solution is offered, the bidder must explain the equivalence and provide supporting evidence.
