The bidder must confirm that neither the company nor its management, supervisory bodies or authorised representatives are subject to exclusion grounds. These include final convictions within the last five years, or an ongoing exclusion obligation, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and illegal use of child labour or other forms of human trafficking. The bidder must also confirm compliance with tax and social security payment obligations. The stated threshold for both tax and social security arrears is EUR 0; the notice explains that an Estonian tax debt certificate is generally not issued where the debt is below EUR 100 or payment has been deferred. Further exclusion grounds cover agreements with creditors, bankruptcy or comparable insolvency proceedings, liquidation or court-appointed administration, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated failures under previous public contracts, false or missing information, failure to submit requested documents, and breaches of environmental, social or labour law. National grounds also concern enabling illegal employment of foreign nationals, international sanctions, and convictions for tax offences. The bidder must provide the required yes/no confirmations and, where relevant, details and evidence. Self-cleaning information may be submitted where legally permitted or provided for in the procurement documents.

The notice does not specify a turnover threshold, minimum previous experience requirement or mandatory project team. The bidder must nevertheless meet the following qualification and compliance requirements for the relevant lots: - submit the participation application in the required form; joint bidders must appoint an authorised representative and submit the corresponding power of attorney; - have the right to sell the offered products in Estonia and provide proof from the manufacturer or, where applicable, the manufacturer’s authorised representative, including evidence of any onward authorisation; - submit a compliant tender covering all product names in each selected lot, using the required price structure and the required price form; - state unit prices and lot totals in euros to two decimal places, including all costs related to delivery to the dental clinic of Tartu University Hospital in Tartu; unit prices must be final and include no additional charges; - provide information on the offered products and the discount percentage for products outside the purchase basket; - ensure that products bear the CE marking and are placed on the market in accordance with Regulation (EU) 2017/745 or its transitional provisions, and submit the relevant declarations of conformity and, where applicable, certificates or copies, with the offered products clearly identified; - confirm compliance with the procurement documents and explain equivalence and provide supporting evidence where an equivalent product is offered; - be prepared to provide original-packaged product samples on request. Up to four samples per offered product may be requested, they must be submitted within two working days, and they will not be returned or reimbursed; failure to provide them may result in the tender being deemed non-compliant; - provide a web-based electronic ordering environment or equivalent solution that supports product searches, entry of quantities, electronic submission and confirmation of orders, and access to the current product range and prices; - confirm that the offered goods are not subject to international sanctions and are not from sanctioned territories, and that restricted subcontractors or suppliers covered by the EU Russia sanctions are not used for more than 10% of the contract value; - submit the required confidentiality statement and any other documents requested in the tender documents.
