Compliance requirements
The bidder must confirm that neither it nor its management or supervisory body members or representatives have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. Exclusion may also apply in cases of unpaid taxes or social security contributions, bankruptcy or other insolvency or liquidation proceedings, an arrangement with creditors, assets administered by a liquidator or court, suspended business activities, serious professional misconduct, an agreement distorting competition, an unresolved conflict of interest, or a material or repeated breach of previous public contracts resulting in termination, damages or sanctions. The bidder must not have provided false information, failed to submit required information or documents, or attempted to improperly influence the contracting authority's decisions. Environmental, social and labour-law obligations must be complied with. Under Estonian law, the authority will also consider enabling the employment of a foreign national without a legal basis, the applicability of international sanctions, and convictions for tax offences. For tax or social security debts, the notice specifies a threshold of EUR 100. Where an exclusion ground exists, evidence of remedial measures may be submitted where permitted by the tender documents.
Qualification criteria and exclusion grounds
The machine-readable notice did not specify precise turnover, previous experience, staffing or other selection requirements; these must be checked in the tender documents. The bidder must submit a compliant tender with the required documents: a lighting calculation including all items described in section 4 of the technical description, a luminaire technical data sheet containing the characteristics required in section 5 of the technical description, a statement confirming separate replaceability of modules and recyclability of materials, and load calculations for the mast and crossbeam or crossbeams referred to in sections 4 and 5.3 of the technical description. Links may not be used instead of the technical data sheet. In the case of a joint tender, a power of attorney from the joint tenderers must be submitted. The tender must comply with the procurement documents, the price must be submitted in the required structure, and the tender must remain valid for 2 months from the tender submission deadline. If an equivalent solution is offered, its equivalence must be explained and supported by evidence.
