Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds applies. These include relevant convictions of the bidder or its representatives for participation in a criminal organisation, breach of integrity, corruption, fraud, terrorist offences, money laundering or terrorist financing; enabling illegal employment or breaches of foreign workers’ employment conditions; offences involving illegal child labour or human trafficking; and outstanding state taxes, duties, environmental charges or social security contributions. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract, or that has submitted false information or failed to provide required information or additional documents. Participation is not permitted for undertakings established or resident in the Russian Federation or Belarus.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement during the 60 months preceding the start of the procedure. At least one of these contracts must have a value of at least EUR 40,000 excluding VAT. A list must be submitted showing the performance period, the other contracting party’s details and representative’s contact information, including telephone number and email address, and the reference numbers for public contracts. Evidence of proper performance must be provided upon request unless the contracting authority can obtain it from public or private databases without significant cost.
The bidder must have a person with valid switching rights for work-related switching operations in the 0.22–20 kV electricity network, excluding regional and distribution substations. For low-voltage-only works, at least low-voltage switching rights are required; in other cases both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side. This person must be registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person responsible for the work operation, registered in the same portal before tenders are opened, and a person managing electrical works with valid A competence and/or a qualification of at least level 6 under the Vocational Qualifications Act, supported by evidence and registered in the portal before tenders are opened.
The tender must include the completed pricing table with all unit-price fields filled in, comply with all procurement documents and contain no additional or conditional terms. The bidder must provide the name, position and contact details of the contract signatory and the contract-performance contact person, together with evidence of signatory authority; a power of attorney is required if the authority does not arise from the articles of association. The bidder must state and justify any trade secrets, but may not classify the tender price or other prohibited price-related indicators as trade secrets.
