Compliance requirements

The bidder must confirm that neither the company nor its management, administrative or supervisory body members or authorised representatives have relevant final criminal convictions, including for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, unlawful use of child labour or trafficking in human beings. The confirmations also cover proper payment of taxes and social security contributions, the absence of bankruptcy or insolvency proceedings, suspension of business activities, creditor arrangements, conflicts of interest, competition-distorting agreements, material breaches of previous public contracts and the submission of accurate and complete information. The bidder must also confirm that there are no breaches of environmental, social or labour law, no obstacles related to international sanctions and no participation restriction arising from legislation or the tender documents. The threshold for tax and social security debt is EUR 0; however, the Estonian tax authority does not issue a debt certificate for a debt below EUR 100 or for rescheduled tax debt. Where applicable, the bidder may provide evidence of remedial measures demonstrating restored reliability. The names and personal identification codes of authorised persons not visible in the commercial register, or confirmation that no such persons exist, must also be provided.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least one contract for the sale and/or installation of traffic management equipment during the 36 months preceding the start of the procurement. The requirement varies by lot: at least EUR 5,000 excluding VAT for Lot 1, EUR 9,000 for Lot 2, EUR 20,000 for Lot 3 and EUR 13,000 for Lot 4. The tender must include, in the ESPD, a list of such contracts with their value, dates, contracting party and performance details; upon request, the bidder must provide a certificate from the client confirming the contract subject, value, completion period and proper performance. If relying on another entity’s capacity, the bidder must provide that entity’s details and a separate ESPD, and, upon request, the consent required by HD Form 2b; the supporting entity must participate in contract performance at least to the extent covered by its relied-upon capacity. For the relevant lot, the bidder must submit the fully completed bill of quantities as an MS Excel file, without changing the purchaser’s specified lines, names, descriptions, parameters, units or quantities. Prices must be stated in euros to two decimal places. The bidder must confirm compliance with the tender documents and provide explanations and evidence of equivalence where necessary. For a joint tender, separate ESPDs for all joint bidders and a signed power of attorney appointing the common representative are required. The bidder must identify and justify any trade secrets; tender prices and lot prices may not be classified as trade secrets. Subcontractors or suppliers who are Russian nationals, residents or entities established in Russia, or entities owned or controlled by them, may not account for more than 10% of the contract value. The offered goods must not be subject to international sanctions or originate from sanctioned regions.
