Compliance requirements

The bidder must confirm that neither the company nor its relevant directors, representatives or controlling persons have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of trafficking in human beings. The bidder must also not have outstanding tax or social security payment obligations, unless these have been settled or covered by a binding payment arrangement. Other exclusion grounds include agreements with creditors, bankruptcy or similar insolvency proceedings, liquidation or court-appointed administration of assets, suspended business activities, serious professional misconduct, anti-competitive agreements, an unavoidable conflict of interest, involvement in preparing the procurement giving an unfair advantage, serious or repeated breaches of previous public contracts, and false or missing information or failure to submit requested documents. The bidder must also comply with the national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where an exclusion ground applies, evidence of remedial measures may be submitted where legally permitted. The bidder must provide the required declarations and, where requested, supporting evidence.

Qualification criteria and exclusion grounds

The bid must identify any trade secrets and justify that designation; the bid price and other legally non-confidential evaluation figures may not be classified as trade secrets. The bid must include the details of the contract signatory and contract contact person, and an authorisation must be submitted if the contract is signed by an authorised representative.
