Compliance requirements
The bidder must confirm that none of the exclusion grounds specified in Section 95(1), points 1–3 and 5 of the Estonian Public Procurement Act, taking account of Section 95(2), apply. The bidder must not be bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, have suspended business activities, or be in a comparable situation.
The bidder must not have outstanding state taxes, duties, environmental charges, tax debts or social security contribution debts. The bidder must confirm that its employees’ average remuneration during the reference period exceeded 70% of the average remuneration in the field corresponding to the subject matter of the contract during the same period. The reference period is six calendar months ending in the month before the month preceding the start of the procurement procedure. This must be evidenced by an extract from the Estonian Tax and Customs Board; a foreign bidder must provide evidence from an equivalent competent authority. In a joint tender, evidence must be provided for each joint bidder.
The bidder must confirm that it is not a related person of the technical consultant advising the beneficiary on the reconstruction of the apartment building. In a joint tender, exclusion grounds are checked separately for each joint bidder.
Qualification criteria and exclusion grounds
The bidder must be registered in Estonia’s register of economic activities for construction with the following activity types: general construction, indoor climate systems, and internal or associated water supply or sewerage systems. If electrical works are performed, the bidder must also be registered for electrical works involving the construction, including installation, of electrical installations. A foreign bidder may provide equivalent evidence of competence.
The bidder’s net turnover in the financial year preceding the start of the procurement procedure must be at least twice the estimated contract value excluding VAT. If the financial year is the calendar year, this concerns 2025. The exact turnover amount depends on the estimated contract value, which is not specified in the input.
The bidder must be able to provide, by the contract signing date or within 10 calendar days after signing, a performance security equal to 5% of the contract value. An approved guarantee from a credit or financial institution is acceptable, as is depositing the corresponding amount into the contracting authority’s or a notary’s account, provided that the contracting authority remains the beneficiary throughout the construction period.
During the 60 months preceding the start of the procurement procedure, the bidder must have completed at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value excluding VAT. The project must have involved the construction, extension or full reconstruction of a building and must have included construction or reconstruction of the building’s load-bearing structures and external envelope, heat-recovery mechanical ventilation, and a new heating system. The bidder must provide the project and building details, completion period, value and information confirming that the required works were included. Completion must be evidenced by a building register notice of use or occupancy permit number, or by a copy of an acceptance certificate signed by the client and contractor.
The team must include at least the following qualified persons: a project manager with at least level 6 construction engineer qualification specialised in building construction and construction activity management, or a level 6 construction manager specialised in general construction; a site manager with at least level 5 construction foreman qualification and comprehensive specialisation in general construction; a ventilation and heating systems specialist with at least a level 6 heating, ventilation and refrigeration engineer qualification and the required competencies for managing heating and ventilation system construction, or an equivalent level 6 construction manager; a water supply and sewerage systems specialist with at least a relevant level 6 engineering qualification or an equivalent construction manager qualification; for electrical works, a person with at least a Class B competence certificate or a level 6 electrical engineer qualification; and an authorised level 7 architect responsible for ensuring compliance of the construction project with the principles of the New European Bauhaus. The bidder must provide each person’s name and qualification or competence certificate number. If a team member is not employed by the bidder or a joint bidder, a written consent to participate must be provided.
The bidder must have a quality management system for construction activities meeting ISO 9001 and an environmental management system meeting ISO 14001 or equivalent requirements. The certificates must be verifiable; if necessary, a certificate copy or other evidence of compliance must be submitted. The tender must be submitted using the contracting authority’s form, conditional tenders are not permitted, and all requirements in the procurement documents must be accepted.
