Compliance requirements
The bidder must confirm that neither it nor its representatives or controlling persons have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, child labour or trafficking-related offences. The bidder must also have no outstanding tax or social security payment obligations, bankruptcy, liquidation or insolvency proceedings, a liquidator managing its assets, suspended business activities or other insolvency situations described in the ESPD.
The bidder must confirm that it has not seriously breached professional, environmental, social or labour-law obligations, distorted competition, had an unresolved conflict of interest, participated in preparing the procurement in a way that created an advantage, or seriously breached previous public contracts. It must also not have submitted false information, failed to provide required information or documents, or improperly obtained confidential information.
National exclusion grounds must also be checked, including employing an unlawfully staying foreign national, being subject to international or Estonian sanctions, tax-related offences, and breaches of restrictions concerning the bidder’s place of establishment or residence. If tax or social security arrears exist, the bidder must state the amount and basis and prove payment or a binding repayment arrangement. Where permitted, remedial measures demonstrating restored reliability may be submitted.
The bidder must confirm that the goods are not subject to sanctions and do not originate from sanctioned regions, that more than 50% of the ownership is not held by Russian citizens, residents or entities established in Russia, and that it does not act under their instructions. It must also not use prohibited Russia-linked subcontractors, suppliers or supporting entities for more than 10% of the contract value or rely on their capacities.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 200,000 in each of the last three financial years completed before the procurement started. Where the financial year is the calendar year, turnover information must be provided for 2023–2025.
The tender must include a technical offer identifying the manufacturer, model and all technical parameters of the proposed confocal laser-scanning microscope system, together with the information needed to verify compliance with the technical specification. The equipment must bear the CE marking upon delivery and must have a warranty of at least 12 months.
The bidder must provide free technical support by email and telephone on working days during the warranty and post-warranty maintenance periods. Remote fault diagnosis must start no later than two working days after notification of a fault. If the fault cannot be resolved remotely, on-site service must be provided within five working days after the need for on-site intervention has been established. Post-warranty maintenance must include at least three service visits during years 2–5 after acceptance of the system.
The tender price must include transport and delivery to the University of Tartu at Riia mnt 23, 50410, including customs and other taxes, on-site installation, operational testing, warranty and maintenance costs, labour, travel, spare parts, accessories, other necessary materials and initial training for the contracting authority’s representatives. The tender must remain valid for at least three months from the submission deadline.
The bidder must submit the ESPD and the required confirmations. Where applicable, an authorised representative’s power of attorney must be included. For a joint tender, the joint bidders’ power of attorney, joint and several liability confirmation and ESPDs for all joint bidders are required. The bidder must also provide the names and personal identification codes of related persons whose details are not visible in the relevant register. If the tender contains trade secrets, their scope and the justification must be submitted separately.
