The bidder must confirm that neither the company nor persons with management, representation or control powers have received a final conviction within the past five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also not be in breach of tax or social security payment obligations, bankrupt, being liquidated or otherwise insolvent, have suspended its business, committed a serious breach of professional conduct, entered into agreements restricting competition, have a conflict of interest, participated improperly in preparing the procurement, or seriously breached previous procurement contracts resulting in termination, damages or sanctions. Grounds for exclusion also include submitting false information, failing to provide required information or documents, improperly influencing the contracting authority’s decision-making, and breaching environmental, social or labour-law obligations. In addition, the bidder must not be subject to an international sanctions ground, a breach related to employing unlawfully staying foreign nationals, or a tax offence. For tax and social security arrears, the stated threshold is EUR 0; the tax authority does not issue a certificate where tax arrears are below EUR 100 or payment has been deferred. Where relevant, the bidder must explain the breach and provide evidence of measures taken to restore its reliability.

Within the 36 months preceding the launch of the procurement, the bidder must have properly completed at least one contract for supplying a CTD probe or an equivalent measuring device used for marine environmental monitoring. The bidder must provide the contract description, total value and currency, its scope of responsibility, the performance period, and the customer’s and contact person’s details, including contact information; where applicable, the source of electronically available information must also be stated. The tender must comply with the tender documents and include the required information and evidence. Conditional tenders are not permitted. The technical tender must describe the required solution: a CTD probe with the additional sensors needed for marine environmental monitoring, capable of recording vertical profiles of water temperature, salinity, dissolved oxygen, turbidity and chlorophyll-a, and technically compatible with the existing profiling platform of Tallinn University of Technology’s Keri seabed station, Flydog Solutions OÜ SALLA. The tender price must follow the prescribed pricing structure. If an equivalent solution is offered, its equivalence must be explained and supported by evidence. For a joint tender, a power of attorney for the joint tenderers must be included. The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers who are Russian citizens, residents or entities established in Russia, or entities owned or controlled by them or acting on their instructions. The tender must confirm that the goods are not subject to international sanctions and do not originate from sanctioned territories.
