The bidder must confirm that neither it nor its representatives, management or supervisory board members have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, unlawful use of child labour or human trafficking offences. The bidder must also have no outstanding tax or social security contribution debt, unless the obligation has been duly fulfilled or a binding repayment agreement has been concluded. The threshold for tax debt is EUR 0; under Estonian rules, the tax authority does not issue a tax-debt certificate where the debt is below EUR 100 or payment has been deferred. The exclusion grounds also cover bankruptcy, liquidation or other insolvency proceedings, assets being administered by a liquidator or court, suspended business activities, an arrangement with creditors, serious professional misconduct, agreements restricting competition, conflicts of interest, involvement in preparing the procurement, serious breaches of previous public contracts, and the submission of false information or failure to provide required documents. Breaches of environmental, social and labour-law obligations must also be taken into account. The bidder must confirm that entering into the contract would not breach international or Estonian sanctions and that neither it nor its legal representatives have been convicted of tax offences or involved in enabling unlawful employment. Where an exclusion ground applies, evidence of remedial measures restoring the bidder’s reliability may be submitted in cases where this is permitted.

The machine-readable notice did not specify precise turnover, previous experience, staffing or other separate qualification criteria; these must be checked in the tender documents. Tenders may be submitted for up to all six lots, and a contract may be awarded to one bidder for up to six lots. For each relevant lot, the tender must be submitted using Annex 1, the technical description and tender form. The tender price must follow the structure specified in the worksheet for award criteria and rated indicators. Conditional tenders are not permitted. The bidder must provide the manufacturer’s catalogue, information material, technical data sheet or other documentation allowing compliance with the technical specification to be verified. All products must bear the CE marking, comply with Medical Device Regulation (EU) 2017/745 and be DEHP-free. Manufacturer-issued documents confirming compliance must be provided for each product. Where necessary, equivalence must be explained in the tender and supporting evidence of equivalence must be included. At the contracting authority’s request, the bidder must provide samples of the offered products in their original packaging within five working days of receiving the request, to Herne 29, Tallinn. The packaging must be sealed and marked with the procurement title, reference number and bidder’s name. Failure to provide samples, or non-compliance identified during functional testing, may result in rejection of the tender. In the case of a joint tender, a power of attorney from the joint bidders must be submitted. The bidder must identify and justify any trade secret, but the tender price and other numerical indicators related to tender evaluation may not be classified as trade secrets. The bidder must confirm that prohibited subcontractors or suppliers with the specified Russian connections will not account for more than 10% of the contract value and that the offered goods are not subject to international sanctions and do not originate from a sanctioned region.
