The bidder must confirm that neither it nor its representatives or members of its management and supervisory bodies have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, unlawful use of child labour or human trafficking. Grounds for exclusion may also include tax or social security debt, bankruptcy or insolvency and liquidation proceedings, an agreement with creditors, assets managed by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, a conflict of interest or a serious breach of a previous public contract. The bidder must not submit false information, omit required information or documents, or attempt to improperly influence the contracting authority. Breaches of environmental, social or labour-law obligations and enabling illegally staying foreign nationals to work are also covered. The bidder must confirm proper payment of taxes and social security contributions; the threshold is EUR 0, subject to the tax authority rule concerning tax debts below EUR 100 or deferred tax debts. The bidder must also confirm that awarding the contract would not breach international or Estonian sanctions. In certain cases, the bidder may provide evidence of remedial measures taken to restore its reliability.

The machine-readable notice does not set out separate precise requirements for turnover, previous experience, staffing or professional qualifications; these must be checked in the tender documents. The tender must be submitted using the required technical description and tender form in Annex 1 and must comply with the technical specification. Conditional tenders are not allowed. The tender price must follow the structure specified in the worksheet for award criteria and rated indicators. For each product, the bidder must provide the manufacturer's technical description, catalogue, information material or other technical documentation, together with manufacturer-issued conformity evidence. Products must bear the CE marking, comply with Medical Device Regulation (EU) 2017/745 and be DEHP-free. At the contracting authority's request, samples must be supplied in their original packaging within five working days of notification to Herne 29, Tallinn; the package must be sealed and marked with the tender title, reference number and bidder's name. Failure to provide samples, or non-compliance identified during functional testing, will make the tender non-compliant. Where applicable, equivalence must be explained and supported by evidence. In a joint tender, a power of attorney for the joint bidders must be provided. The bidder must identify and justify any trade secrets, but may not classify the tender price or other prohibited rated figures as trade secrets. The bidder must also confirm that it will not use, for more than 10% of the contract value, sanctioned Russian-origin or Russia-related subcontractors or suppliers, and that the goods are not subject to international sanctions and do not originate from a sanctioned region.
