Compliance requirements
The bidder, its representative, or a member of its management, administrative or supervisory body must not have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies to convictions for enabling illegal employment, breaching the conditions for employing a foreign national in Estonia, including paying below the required wage rate, illegal use of child labour or trafficking in human beings. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax or social security contribution arrears under the law of its country of establishment.\n\nThe contracting authority may also exclude a bidder for a serious or repeated breach of a previous public contract where this resulted in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. Exclusion may also result from providing false information concerning the selection criteria or failing to submit required information or documents.\n\nAn entity established or residing in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components originating from or produced in those countries may not be used in the works; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the contract. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, the contracting party representative’s contact details and, for public procurements, the reference numbers; upon request, proof of proper completion must be provided.\n\nThe bidder must have an employee with valid switching authorisations for the switching operations required for the works, registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage works only, at least MP switching authorisations are required; in other cases, both MP and KP switching authorisations are required. The bidder must also have a person responsible for the work operation with valid rights, registered in the same portal before tenders are opened.\n\nThe person managing the electrical works must hold valid A competence or a qualification of at least level 6 within the meaning of the Vocational Qualifications Act, possess the relevant proof and be registered in Elektrilevi’s partner portal before tenders are opened. The tender must comply with all tender document requirements, be unconditional and include a properly completed price table with every unit-price field filled in. The bidder must provide the details of the contract signatory and the contact person for contract performance, together with a power of attorney where necessary. The previous contract information form must also be submitted.
