The bidder must confirm that neither the company nor its management, supervisory body members or representatives has received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, illegal employment of children or human trafficking. Payment of taxes and social security contributions is also checked; the tax debt threshold is EUR 100, subject among other things to the exception for deferred tax debt. Other exclusion grounds may include bankruptcy, insolvency or liquidation proceedings, suspended business activities, serious professional misconduct, agreements restricting competition, conflicts of interest, involvement in preparing the procurement, serious breaches or early termination of previous contracts, false information and failure to submit required documents. The bidder must also confirm that no exclusion ground applies in relation to the unlawful employment of foreign nationals, international sanctions or tax offences. Where an exclusion ground exists, evidence of measures restoring the bidder’s reliability may be submitted in certain cases.

Within the 36 months preceding the start of the procurement, the bidder must have completed at least two sales contracts for comparable X-ray equipment, specifically cone-beam computed tomography equipment, and delivered the equipment to the purchaser in a compliant, ready-to-use condition. For each supply, the bidder must provide the purchaser’s details, the procurement reference number where applicable, the equipment name and handover date, together with contract value information. The bidder must hold a manufacturer’s or authorised supplier’s right to represent or sell the proposed equipment in Estonia or the European Union and must submit confirmation of that right. The tender must include the completed technical tender form, the completed price submission, the required supporting materials and a maintenance plan covering both the warranty period and post-warranty maintenance. The maintenance plan must describe the expected maintenance intervals, work to be performed and other relevant information. During contract performance, the bidder must have a qualified engineer or technician in its service team who has been trained by the manufacturer to maintain and repair the proposed equipment. Before submitting the tender, the bidder must inspect the installation site in person; a tenderer who has not inspected the site will have its tender rejected. The tender must comply with the procurement documents and must be unconditional; where necessary, equivalence must be explained and supported by evidence. The bidder must also confirm that the proposed goods are not subject to international sanctions and do not originate from a sanctioned region. In the case of a joint tender, a power of attorney for the joint tenderers must be submitted.
