Compliance requirements

The bidder must confirm that neither the bidder nor any member of its representative, management or supervisory body has, during the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence or an offence related to terrorist activity, money laundering or terrorist financing, or the use of child labour or human trafficking. The bidder must also have no outstanding taxes or social security contributions, and concluding the contract must not breach an international or Estonian sanction. A conviction related to enabling an unlawfully staying foreign national to work or breaching the conditions for employing a foreign national in Estonia is also a ground for exclusion. If tax or social security debt exists, the bidder must provide information about the debt and its payment or a binding repayment arrangement. Where an exclusion ground applies, the bidder may submit evidence of remedial measures restoring its reliability where this is permitted by law or the tender documents.

Qualification criteria and exclusion grounds

The bidder’s average total net turnover for the last three financial years (01 January 2023 to 31 December 2025) must be at least EUR 120,000. As the main contractor, the bidder must engage a responsible specialist, namely the works project manager or site manager, for managing the road maintenance works. This person must hold at least a level 6 professional qualification as a road engineer or an equivalent qualification. The tender must state the person’s name and the professional certificate number recorded in the professional register. At the contracting authority’s request, the bidder must also provide documents proving the person’s education and professional qualification, together with the person’s written consent to participate in the works. The tender must comply with all tender document requirements. The bidder must submit the participation application using Form 1 and the price submission using Form 2. The total price excluding VAT and unforeseen works must be identical in Form 2 and in the procurement system’s price form. The price must include all necessary labour, tax, construction machinery, equipment and material costs and remain final throughout the contract period.
