Compliance requirements
The bidder will be excluded if the company or any member of its administrative, management or supervisory body, procurator, or other person with authority to represent, control or make decisions for it has been convicted of participation in a criminal organisation, corruption, fraud, terrorism or terrorist support, money laundering, employing an unlawfully residing foreign national or paying that person below the legally required wage, unlawful use of child labour, or human trafficking. The bidder must also have no outstanding state tax, payment or environmental charge debt, and no tax or social security contribution debt under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of an earlier public contract, contract termination, price reduction, compensation payment or contractual penalty, or for submitting false information or failing to provide required information or documents. The bidder must confirm that these exclusion grounds do not apply. Companies established in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components originating from or produced in those countries may not be used in the works; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
During the 60 months preceding commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this contract. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties, the contracting authority representative’s telephone number and email address, and reference numbers for public contracts. At the contracting authority’s request, the bidder must provide evidence of proper performance, unless the contracting authority can obtain the information from databases without disproportionate cost. The team must include a person with valid switching authorisations who was registered in Elektrilevi’s partner portal before the tender submission deadline. For low-voltage works only, at least low-voltage switching authorisations are required; in other cases, both low- and medium-voltage switching authorisations are required. The team must also include a person responsible for the work operation, registered in the portal before the deadline, and an electrical works manager with valid A competence or a qualification corresponding to at least level 6, holding the relevant evidence and registered in the portal. The tender must comply with the procurement documents, be unconditional, and include a fully completed price table. The bidder must also provide the details of the signatory and the contact person for contract performance and, where necessary, a power of attorney, the previous contracts form and any other documents required by the procurement documents.
