Compliance requirements

The bidder, its management, administrative or supervisory body members, and persons authorised to represent it must not have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Exclusion may also apply in cases of unpaid taxes or social security contributions, bankruptcy or other insolvency or liquidation proceedings, assets being administered by a liquidator or court, suspended business activities, serious professional misconduct, agreements restricting competition, a conflict of interest, or involvement in preparing the procurement procedure. Previous serious breaches of public contracts may also be relevant, including early termination, damages or contractual penalties. Exclusion may result from providing false information, failing to submit required information or documents, or seeking confidential information to obtain an unfair advantage. Breaches of environmental, social or labour law obligations, enabling an unlawfully present foreign national to work, breaches of international or national sanctions, and the statutory tax offences listed in the notice may also be relevant. Where applicable, the bidder may provide evidence of remedial measures demonstrating its reliability.

Qualification criteria and exclusion grounds

The bidder must submit a tender complying with the procurement documents and the participation statement using Form 1. Conditional tenders are not permitted. The tender price must be submitted in the required structure and using Form 4. The bidder must describe the proposed equipment and provide the required descriptions and explanations from Annex 1 of the tender documents. Where an equivalent solution is offered instead of a standard, label, technical solution or other basis referred to in the procurement documents, the bidder must explain the equivalence and provide supporting evidence. The bidder must have at least one specialist trained by the manufacturer to maintain and repair the equipment. A copy of the document proving the specialist’s manufacturer training must be included with the tender. If the person signing the tender does not have representative authority shown in the register, a power of attorney proving the authority must be submitted using Form 2. In a joint tender, the joint bidders must appoint an authorised representative and include the power of attorney required by Form 3. The machine-readable notice does not specify turnover, previous experience or other financial-capacity requirements; any such requirements must be checked in the tender documents.
