Compliance requirements
The bidder must confirm that neither it nor its management, supervisory body members or representatives has been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, unlawful use of child labour or human trafficking-related offences. The bidder must also have no tax or social security debt, bankruptcy, insolvency or liquidation proceedings, suspended business activity, serious professional misconduct, anti-competitive agreement, unresolved conflict of interest or material breach of a previous public contract. Exclusion grounds also cover false statements, failure to provide required information or documents, and improper attempts to influence the contracting authority's decision-making. Compliance with environmental, social and labour-law obligations is also checked. For tax and social security payments, the notice specifies a EUR 100 threshold and an exception for deferred tax debt. The bidder must also confirm compliance with international sanctions; a contract must not be void because of sanctions. Where an exclusion ground applies, evidence of remedial measures may be submitted where permitted. First-tier subcontractors must submit a European Single Procurement Document and are subject to the relevant exclusion grounds.
Qualification criteria and exclusion grounds
The machine-readable notice does not specify concrete thresholds for turnover, previous experience, personnel, professional qualifications or other financial or technical capacity; the precise selection and suitability criteria must be checked in the tender documents. The bidder must submit the electronic European Single Procurement Document and evidence of proper payment of taxes and social security contributions, or information enabling the contracting authority to verify this. The tender must include all documents, data and other evidence needed to demonstrate compliance of the equipment. These materials must identify the manufacturer, model and technical characteristics and show compliance with the contracting authority's requirements; a generic declaration is insufficient. The tender must comply with all tender documents, and conditional tenders are not permitted. Where relevant, equivalence must be explained and supporting evidence provided. The bidder must identify any trade secrets and justify that designation, but may not classify the tender price or numerical indicators related to the award criteria as trade secrets. In a joint tender, a power of attorney for the joint tenderers must be submitted. The bidder may not involve, for more than 10% of the contract value, Russian persons or entities subject to the specified sanctions, or subcontractors or suppliers owned or directed by them.
