Compliance requirements
A bidder will be excluded if the bidder or a member of its management, representative or supervisory body has been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, enabling unlawful employment, unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding state taxes, duties or environmental charges, or unpaid tax and social-security contributions in its country of establishment, or where awarding the contract would breach an international or Estonian Government sanction.
The contracting authority may exclude a bidder for breaches of environmental, social or labour-law obligations; bankruptcy or liquidation; suspended business activities; serious professional misconduct; local tax debt; anti-competitive agreements; an unavoidable conflict of interest; an unjustified advantage obtained through involvement in preparing the procurement; serious or repeated breaches of previous procurement contracts; false information; attempts to influence the contracting authority or submission of misleading information; tax offences; or lack of the right to submit a bid.
The bidder must submit the prescribed confirmation that no exclusion grounds apply. If the bidder relies on another entity’s resources to demonstrate technical or professional capacity, the same confirmation must also be submitted for that entity.
Qualification criteria and exclusion grounds
The bidder must have delivered, between 1 January 2023 and the publication of the contract notice, either vocational education covering a warehouse worker, logistics and warehouse management, or transport-logistics curriculum, or group training for warehouse workers, cargo handlers, or logistics and warehouse management that included forklift operation and maintenance and amounted to at least 200 contact-teaching hours. Independent-study hours do not count towards the 200 contact hours. The bidder must submit the required qualification information and state whether it relies on another entity’s resources.
The bidder must confirm that it has not materially breached administrative contracts and that no circumstances exist that could lead to permanent insolvency or termination of its activities. In a joint tender, each consortium member must meet these requirements. They do not apply to a public-law entity.
The bid must include the names of the lecturers, the required lecturer information, details of the lecturer for the forklift-driver module, and a copy of a document proving the lecturer’s professional or higher education qualification. The bidder must also submit the curriculum in the required form and the training venue address. Training must take place at the location specified in the tender documents, no more than a 10-minute walk from an official public transport stop. Joint tenderers must provide an authorisation. The bidder must confirm compliance with the tender documents and provide equivalence evidence where necessary. It must also confirm compliance with sanctions requirements and identify and justify any trade secrets; the bid price and numerical figures relevant to evaluation cannot be classified as trade secrets.
