Compliance requirements

The bidder must confirm that neither it nor its representatives or management and supervisory body members have, within the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Exclusion grounds may also include tax or social security arrears, an agreement with creditors, bankruptcy or other insolvency or liquidation proceedings, assets managed by a liquidator or court, or suspended business activities. The procurement also addresses serious professional misconduct, agreements distorting competition, conflicts of interest, involvement in preparing the procurement, material breaches of previous public contracts, false information, failure to provide required information or documents, and breaches of environmental, social or labour law obligations. National exclusion grounds additionally cover enabling an unlawfully staying foreign national to work, breaches involving international sanctions, and convictions for tax offences. Where an exclusion ground applies, the bidder may submit evidence of remedial measures restoring its reliability if this is permitted by the tender documents. The bidder must also confirm that the proposed goods are not subject to international sanctions and do not originate from sanctioned regions.

Qualification criteria and exclusion grounds

The machine-readable procurement passport does not specify particular turnover, previous experience, staffing or other separate selection criteria. However, the bidder must submit a compliant tender with the technical description and tender form in Annex I to the procurement documents and comply with all requirements set out in the tender documents. The tender must include the details of the person authorised to sign the contract and the contact person for contract performance, including name, position, telephone number and email address. All proposed products must bear the CE marking, supported by documents issued by the manufacturer. The characteristics and technical compliance of the proposed products must be demonstrated with manufacturer information or technical documentation. The tender price must follow the structure provided on the evaluation criteria and rated indicators sheet. Where relevant, equivalence must be explained and supported with evidence. The bidder must be prepared to provide two jackets in each required size for testing within five working days of the contracting authority’s notice; failure to provide the samples will result in the tender being deemed non-compliant. The bidder must identify any trade secret and give reasons for its classification, or state that the tender contains no trade secrets. The bidder must also confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions, and that prohibited Russia-linked subcontractors or suppliers will not be used for more than 10% of the contract value.
