The bidder, its management or supervisory board members, and persons authorised to represent it must not have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, or offences involving the illegal use of child labour or human trafficking, unless the exclusion period has ended or the contracting authority accepts remedial measures demonstrating reliability. The bidder must not have outstanding tax or social security payment debts. There must also be no violations relating to employing foreign nationals without a legal basis, breaches of international sanctions, or breaches of participation restrictions set out in the tender documents. The bidder must provide the required declarations in the ESPD and, where applicable, evidence and explanations concerning exclusion grounds.

The bidder must be registered in the business register of its country of establishment; for an Estonian company, the business register details and, where required, proof of registration must be provided. No other specific financial capacity or previous experience requirements are stated in the machine-readable notice. The tender must comply with the tender documents and must be unconditional. The tender price must follow the required structure and include the design and manufacture of the goods, delivery and installation at the contracting authority’s site at Ravi 2, Pärnu, and handover of the documentation. The bidder must submit the tender declaration using the required form, including a tender validity period of at least three months. Joint bidders must submit a power of attorney for their authorised representative; if the signatory’s authority to represent the bidder is not shown in the register, a separate power of attorney must also be submitted. The goods must comply with the technical requirements; if an equivalent solution is offered, its equivalence must be explained and supported by evidence. The bidder must confirm that the goods are not subject to international sanctions and do not originate from a sanctioned region.
