Compliance requirements

The bidder must confirm that neither the company nor persons with management, supervisory or representation powers have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations and must not have breached obligations concerning the employment of foreign nationals residing without a legal basis. The bidder must confirm that entering into the contract would not breach international or Estonian sanctions. Where relevant, the bidder must provide information on the conviction, the exclusion period and measures taken to restore its reliability. During contract performance, suppliers or subcontractors that are Russian citizens, residents or entities established in Russia, or entities controlled by or acting on behalf of such persons, may not account for more than 10% of the contract value.

Qualification criteria and exclusion grounds

The bidder must be an entity registered in Estonia’s commercial register or register of non-profit associations and foundations and must hold a non-life insurance licence issued by the Estonian Financial Supervision and Resolution Authority. A bidder registered abroad must be included in the register of cross-border non-life insurance service providers maintained by the Authority. The bidder must confirm compliance in the European Single Procurement Document, and the contracting authority will verify the licence or registration on the Authority’s website. The machine-readable notice did not specify financial capacity, previous experience or staffing requirements; any such requirements must be checked in the tender documents. The tender must include the completed insurance object price table including VAT, and its total must equal the tender price submitted in the procurement register. The bidder must also submit the required confirmation of participation in the public procurement and a free-format document setting out the insurer’s insurance terms applicable to the tender. The tender must comply with all tender document requirements; conditional tenders are not permitted, and any claimed equivalence must be explained and supported by evidence where necessary.
