Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives is subject to any exclusion ground. The checks cover, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering and terrorist financing, illegal use of child labour, breaches of tax or social security payment obligations, bankruptcy or insolvency, liquidation, suspension of business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, improper involvement in preparing the procurement, material breaches of previous contracts, and the submission of false information or failure to provide required documents. National grounds are also checked concerning enabling illegally staying foreign nationals to work, international sanctions and tax offences. The bidder must provide the required declarations and, where an exclusion ground applies, describe the circumstances and any measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The machine-readable notice did not include precise financial capacity, previous experience, turnover or staff qualification requirements; these must be checked in the tender documents. The tender must be complete, unconditional and compliant with all procurement document requirements. The bidder must complete the sample tender form “314671 Appendix 1_Chemicals list_2026-2029.xlsx” and submit the tender price using the structure specified in the worksheet “Award criteria and measurable indicators”. The bidder must confirm compliance with the requirements and, where applicable, explain the equivalence of the proposed solution and attach evidence of equivalence. In a joint tender, a power of attorney for the joint bidders’ authorised representative must be submitted. The bidder must identify any trade secrets and justify their designation; the tender price and prohibited evaluation-related figures may not be classified as trade secrets. The bidder must also confirm that it will not use a subcontractor subject to replacement due to an exclusion ground.
