Compliance requirements

The bidder must confirm that neither the company nor persons with management, representation or control functions are subject to exclusion grounds. These include final convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, trafficking in human beings or illegal child labour. The tender also checks payment of taxes and social security contributions, compliance with environmental, social and labour-law obligations, bankruptcy or other insolvency, liquidation, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious breaches of previous contracts, and the submission of false information or failure to provide required documents. Confirmations are also required regarding national exclusion grounds, international sanctions and possible local tax debt at the contracting authority’s location. Where relevant, the bidder must describe the breach and remedial measures taken to restore reliability and provide evidence at the contracting authority’s request.

Qualification criteria and exclusion grounds

During the 36 months preceding the procurement, the bidder must have properly completed at least three contracts for fire alarm system and emergency lighting maintenance. Each reference contract must have a value of at least EUR 50,000 excluding VAT. The reference list must include the contract value, dates, client details and contact information, and the procurement reference number where applicable. Only the part of the service delivered to and accepted by the client during the reference period is counted; improperly performed contracts will not be accepted. At least three employees responsible for the service must hold level 5 professional qualifications under the occupational standard for a responsible security systems specialist or technician, or equivalent qualifications. A professional certificate must be submitted for each of the three persons. The bidder must hold a valid activity licence issued by the Estonian Police and Border Guard Board for security services covering the guarding and protection of movable or immovable property and the operation of a control centre. In addition, the bidder or its subcontractor must be registered in the Estonian Register of Economic Activities in the field of fire-safety installation and maintenance or fire-safety design, construction and maintenance, or hold an equivalent foreign registration or licence. If the bidder relies on a subcontractor’s capacities, the tender must show that the registered or licensed entity will itself perform the relevant part of the contract. The tender must comply with all tender documents, be unconditional and include the fully completed price form in Annex 2. Prices must be submitted in euros both excluding and including VAT, to two decimal places, and must include all costs related to service delivery. Zero or negative prices are not permitted. For a joint tender, a power of attorney for the joint tenderers must be submitted.
