Compliance requirements

A bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, a procurator, or another person with authority to control or represent it, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, enabling unlawful employment, violating conditions for employing a foreign national, unlawful use of child labour or trafficking in human beings. Exclusion also applies where the bidder has outstanding state tax, payment or environmental charge debts, tax or social security debts, or where awarding the contract would breach an international or Estonian sanction. The bidder must confirm that no exclusion grounds apply; in a joint tender, the corresponding confirmation must also be provided for each co-bidder. A bidder registered outside Estonia must, where required, submit a criminal-record certificate or equivalent document and a certificate from the competent authority confirming the absence of tax debts. Participation is limited to businesses established in Estonia, another European Union or European Economic Area country, or a country that is party to the World Trade Organization Government Procurement Agreement. Businesses established in the Russian Federation or Belarus may not participate.

Qualification criteria and exclusion grounds

The bidder must comply with the tender documents and submit an unconditional tender. The person submitting or signing the tender must have authority to represent the bidder; a bidder registered outside Estonia must provide supporting evidence and, where necessary, a power of attorney. In a joint tender, a power of attorney signed by all joint bidders must be submitted, and the joint bidders are jointly and severally liable for contract performance. The bidder must provide the names and personal identification codes of authorised persons, or confirm that it has no such persons with control authority who are not visible in the commercial register. The tender price must follow the prescribed structure. The tender must include a monthly payment schedule for the vehicle showing the contract fee, operational lease principal, interest, residual value and VAT, based on the six-month EURIBOR applicable on the date the contract notice was published. The bidder must provide a sufficiently detailed description and technical data for the proposed vehicle, including the manufacturer’s official technical data, and complete the form for the proposed vehicle data. The vehicle must have an authorised service point of the manufacturer in Haapsalu; the bidder must provide the names, addresses and contact details of the service points, including the Haapsalu service point. The latest delivery date may be no later than 3 calendar months after contract signing. Where relevant, equivalence must be explained and supporting evidence provided. The bidder must confirm that the proposed goods are not subject to international sanctions and do not originate from sanctioned regions. The tender must identify any information claimed as a trade secret and explain the designation; the tender price and indicators related to the award criteria may not be classified as trade secrets.
