Compliance requirements

The bidder must confirm that neither the bidder nor its administrative, management or supervisory body members, procurists, or other persons authorised to represent or control it have been finally convicted within the last five years of, among other things, participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the illegal use of child labour or human trafficking-related offences. Compliance with tax and social security payment obligations is also checked, as are offences involving the employment of unlawfully staying foreign nationals and whether entering into the contract would violate an international or Estonian sanction. Where applicable, the bidder must provide relevant explanations and evidence; remedial measures taken to restore reliability may be described where permitted.

Qualification criteria and exclusion grounds

The machine-readable notice did not include precise financial or previous-experience requirements; these must be checked in the tender documents. The bidder must submit a tender including the completed file “Annex 1 Technical Description” and confirm that the tender complies with all tender-document conditions. Conditional tenders are not permitted. The tender price must be submitted in the structure specified on the award criteria and assessed indicators sheet. If an equivalent solution is offered in relation to a requirement, standard, label or other technical basis specified by the contracting authority, the equivalence must be explained in the tender and supported by evidence. In the case of a joint tender, a power of attorney from the joint bidders must be submitted. The bidder must identify information considered a trade secret and provide reasons; the tender price and other tender indicators that must be disclosed by law may not be classified as trade secrets.
