Compliance requirements
A bidder will be excluded if the bidder, a member of its administrative, management or supervisory body, a procurator, or another authorised representative has been convicted of participating in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering, terrorist financing, or related offences. Exclusion also applies to convictions for enabling unlawful employment or breaching the conditions for employing a foreign national in Estonia, including paying less than the legally required wage, as well as unlawful use of child labour or trafficking-related offences. The bidder must have no state tax, payment or environmental charge arrears, or tax or social security arrears under the law of its country of establishment, and awarding the contract must not breach an international or Estonian sanction. The bidder must confirm that none of these exclusion grounds apply. In addition, the bidder must confirm that it will not use subcontractors or suppliers representing more than 10% of the contract value who are Russian citizens, residents or entities established in Russia, entities owned or controlled by them, or entities acting on their instructions. Otherwise, the tender may be rejected.
Qualification criteria and exclusion grounds
The bidder must be legally entitled to provide the type of insurance covered by the framework agreement under the laws of its country of establishment. A bidder established in Estonia must hold the activity licence specified in Section 15(1) of the Insurance Activities Act or be listed in the Financial Supervision Authority’s register of insurers. If the relevant information is not available on the Authority’s website, the bidder must provide documents proving its authorisation when requested by the contracting authority.
During the 36 months preceding the launch of the procurement, the bidder must have completed at least one contract worth at least EUR 50,000 excluding VAT for health and/or medical insurance. The tender must include the contract title and description, the procurement reference number if available, the start and end dates, the contract value, and the customer’s name, registry code, contact person, email address and telephone number. If the bidder relies on another entity’s resources, it must submit a statement signed by both parties confirming the availability and use of those resources and the parties’ responsibilities. The entity providing the relevant technical or professional capacity must personally perform the relevant contract or part of it, and the parties must be jointly and severally liable for that part.
The tender must comply with all procurement document requirements, and conditional tenders are not permitted. The tender price must be submitted in the prescribed structure. The bidder must provide a description of the critical illness cover and offer, under Health Insurance Package 1, comparable insurance cover for the contracting authority’s employees’ spouses, partners and children up to and including 18 years of age, excluding the premium amount. The premium for a family member must be submitted in a freely formatted document.
For evaluation purposes, the bidder may submit the data requested in Form 1 concerning direct billing arrangements and the relevant healthcare providers. Failure to submit this form is not grounds for rejection, but points may be awarded on the basis of the information. In a joint tender, a power of attorney for the joint bidders must be included. The bidder must identify any processors used for personal data processing and their countries of location, or state that no processors are used. The tender must also identify and justify any trade secrets; the tender price and numerical figures relating to the award criteria may not be classified as trade secrets.
