Compliance requirements

The tenderer must confirm that neither the tenderer nor its management, administrative or supervisory body members or representatives have been finally convicted within the last five years of, among other things, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or human trafficking. Exclusion may also apply because of unpaid taxes or social security contributions, bankruptcy or other insolvency proceedings, assets managed by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement procedure, serious breaches of previous contracts, or the submission of false information or failure to provide required documents. Compliance with environmental, social and labour-law obligations is also checked. For taxes and social security contributions, the stated threshold is EUR 0. National exclusion grounds also cover enabling illegally staying foreign nationals to work in Estonia, international sanctions and tax offences. If an exclusion ground applies, the tenderer may provide information on remedial measures taken to restore its reliability where permitted by the applicable law and tender documents.

Qualification criteria and exclusion grounds

The machine-readable notice and the provided ESPD text did not specify precise turnover, previous experience, staffing or other separate selection criteria; these must be checked in the tender documents. The tenderer must nevertheless submit Form 2 for each lot concerned and complete the required ESPD confirmations. The tenderer must confirm that the bid complies with the tender documents and, where necessary, provide explanations and evidence of equivalence. In a joint tender, a power of attorney for the joint tenderers must be submitted. The tenderer must identify any trade secrets and justify their classification, or confirm that the bid contains no trade secrets; the bid price and lot prices may not be classified as trade secrets. The tenderer must confirm that it will not use Russian-linked subcontractors or suppliers for more than 10% of the contract value and that the offered products are not subject to international sanctions or originating from sanctioned regions.
