Compliance requirements

The bidder must not be subject to exclusion grounds, including a final conviction within the last five years, or an ongoing exclusion obligation, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour or other forms of trafficking in human beings. Compliance with tax and social security payment obligations is also checked. The threshold for tax and social security debt is stated as EUR 0; the tax authority does not issue a certificate where tax debt is below EUR 100 or payment has been deferred. The bidder must also confirm that awarding the contract would not breach an international or Estonian sanction and that it has not enabled a foreign national staying in Estonia without a lawful basis to work. Where permitted by the contracting authority, remedial measures taken to restore reliability may be considered if an exclusion ground applies; such measures and supporting evidence must be described where relevant.

Qualification criteria and exclusion grounds

The bidder must hold a wholesale distribution licence for medicinal products issued by the Estonian State Agency of Medicines. The contracting authority will verify the licence in the Medicines Agency licence register. The bid must include the required participation statement (Form 1) and, where the signatory does not have representative authority according to the registry, a power of attorney (Form 2). The offered medicine must have a marketing authorisation, import authorisation or use authorisation issued by the Medicines Agency; copies of the relevant documents must be provided where necessary. The bidder must submit product descriptions and manufacturer materials enabling the contracting authority to verify compliance with the requirements in the tender documents. The price offer must be submitted using Form 4. Conditional bids are not allowed. If an equivalent product is offered, its equivalence must be explained and supported by evidence.
