Compliance requirements

The bidder must confirm that neither it nor its representatives or management body members have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, or offences involving child labour or human trafficking. The exclusion grounds also cover tax or social security payment arrears, breaches of environmental, social or labour law obligations, bankruptcy or another insolvency situation, liquidation, suspended business activities, serious professional misconduct, anti-competitive agreements, unresolved conflicts of interest, and unjustified involvement in preparing the procurement. Grounds for exclusion may also arise from a serious breach of a previous public contract, the submission of false or misleading information, failure to provide required information or documents, or attempts to improperly influence the contracting authority. The bidder must also consider national exclusion grounds concerning the employment of unlawfully staying foreign nationals, international sanctions, and tax offences. Where an exclusion ground exists, the contracting authority may request explanations and evidence; in certain cases, the bidder may submit evidence of remedial measures demonstrating restored reliability.

Qualification criteria and exclusion grounds

The submitted ESPD does not specify a minimum turnover, previous experience, staffing, certificate, or other financial or technical capacity requirement. The bidder must submit the price proposal using the prescribed form and follow the structure specified in the sheet containing the assessable price-related figures.
