Compliance requirements
The bidder must confirm that neither it nor its representatives, management or supervisory body members, or other persons with authority to represent or control it are subject to exclusion grounds. These include, among other matters, final convictions within the last five years or an ongoing exclusion obligation for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and illegal use of child labour or human trafficking. Compliance with tax and social security payment obligations, bankruptcy or insolvency and liquidation proceedings, administration of assets by a liquidator or court, suspension of business, serious professional misconduct, anti-competitive agreements, conflicts of interest, an improper advantage gained through involvement in preparing the procurement, material breaches of previous contracts, and the submission of false information or failure to provide required documents are also checked. National exclusion grounds additionally concern enabling an unlawfully residing foreign national to work, international or Estonian sanctions, and tax offences. Where permitted by applicable law or the tender documents, a bidder affected by an exclusion ground may in certain cases submit evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have the right to sell the offered product in Estonia and must provide a manufacturer’s confirmation of that sales representation right. The offered products must bear the CE marking and be placed on the market in accordance with Regulation (EU) 2017/745 or its transitional provisions. Copies of the applicable conformity certificates or declarations of conformity must be included; where such documents cover several products, the products offered in this procurement must be clearly identified. The bidder must also submit a technical data sheet issued by the manufacturer in Estonian or English, demonstrating compliance with the requirements of the tender documents. The bidder must submit the participation application on Form 1 and the offered product names and price offer on Form 4. The tender must comply with all tender document requirements; conditional tenders are not permitted, and the price must be presented in the required structure. Where an equivalent solution is offered, its equivalence must be explained and supporting evidence attached. In the case of a joint tender, a power of attorney for the joint bidders must be submitted on Form 3. If the person signing the tender does not have representation rights recorded in the register, a power of attorney for representation must be submitted on Form 2. The machine-readable notice did not specify financial capacity, turnover, previous experience or team requirements; any additional requirements of this kind must be checked in the tender documents.
