Compliance requirements
The European Single Procurement Document checks 26 mandatory exclusion grounds concerning the bidder and its administrative, management or supervisory body members, procurists and other persons authorised to represent, control or make decisions for the bidder. The information provided includes final criminal convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking, where the conviction occurred within the last five years or the exclusion period remains in force. Where an exclusion ground applies, the bidder must provide the conviction details and, where applicable, describe measures taken to restore its reliability and submit supporting evidence. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian citizens, residents or entities established in Russia, or entities directly or indirectly more than 50% owned, represented or controlled by such persons. The bidder must also confirm that the goods offered are not subject to international sanctions and do not originate from a sanctioned region; otherwise, the tender may be rejected.
Qualification criteria and exclusion grounds
The machine-readable notice did not specify the bidder’s financial capacity, previous experience or team qualification requirements; these must be checked in the tender documents. The compliance requirements are specified: for each lot offered, the bidder must submit the completed technical description form (Annex 1) and the documents required by that form to prove that the products comply with the requirements. A completed price form (Annex 2) must also be submitted; in the event of a discrepancy between the price form and the price entered in the register, the contracting authority will rely on the price form. The tender must comply with the tender documents, conditional tenders are not permitted, and any equivalent product must be explained and supported by the necessary evidence. In a joint tender, a power of attorney for the joint tenderers must be included. The bidder must identify and justify any trade secret, but the tender price and lot prices may not be classified as trade secrets.
