Compliance requirements

The tenderer must confirm that neither the company nor its management, supervisory body members or representatives are subject to exclusion grounds. These include final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the illegal use of child labour or human trafficking. Compliance with tax and social security payment obligations is also checked; the stated threshold is EUR 0, although the tax authority does not issue a tax debt certificate for a debt below EUR 100 or for a rescheduled tax debt. The exclusion grounds also cover bankruptcy, insolvency or liquidation proceedings, assets managed by a liquidator or court, suspended business activities, serious professional misconduct, agreements distorting competition, conflicts of interest, involvement in preparing the procurement, serious breaches of previous contracts, and the submission of false information or failure to provide required documents. The tenderer must also confirm that no exclusion ground applies in relation to enabling the unlawful employment of a foreign national, international sanctions or tax offences. Where permitted by applicable law and the tender documents, the tenderer may provide evidence of remedial measures restoring its reliability.

Qualification criteria and exclusion grounds

A tenderer may submit a bid for up to three lots, and contracts may be awarded to one tenderer for up to three lots. The machine-readable notice does not specify separate requirements for turnover, previous experience, staffing, registration or professional qualifications. The bid must be unconditional and comply with all procurement document requirements. For each offered lot, the tenderer must submit Annex 1, the technical description, completing all required fields, as well as manufacturer-issued technical data in Estonian or English proving compliance with the technical requirements. The price must be submitted in the required structure and Annex 2, the price form, must also be completed with all required information. For each lot, the tenderer must provide a list of the required operating instrument sets, maintenance conditions and replacement intervals, and ensure the number of sets specified in the technical description. The tenderer must provide the details of the person who will sign the contract if awarded and the contact person for contract performance; if signing under a power of attorney, the power of attorney must be attached. In the case of a joint bid, a power of attorney for the joint tenderers must be submitted. The tenderer must confirm that the goods comply with sanctions requirements and that it will not involve, for more than 10% of the contract value, Russian persons or entities covered by the relevant sanctions. Where applicable, an equivalent solution must be described and evidence of equivalence attached. Any trade secret must be identified and justified; the bid price and indicators used for evaluating a supply contract may not be classified as trade secrets.
