Radionuclide therapy dosimetry software

Summary

The tender concerns the acquisition of a perpetual right of use, or licence, for radionuclide therapy dosimetry software, including installation and training. The software must support individual patient dosimetry, accurate dose calculations and the preparation of dosimetric reports. The tender must also include manufacturer-prescribed software updates for two years from handover of the software. Compliance requirements

The bidder must confirm in the ESPD that no grounds for exclusion apply to the bidder or to its representatives, management, administrative or supervisory body members. The checks cover, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or human trafficking. The bidder must also have no outstanding taxes or social security contributions and must not be affected by bankruptcy, insolvency, liquidation or a similar proceeding. The exclusion grounds also cover breaches of environmental, social or labour law, serious professional misconduct, agreements distorting competition, conflicts of interest, serious breaches of previous contracts, false information or failure to submit required documents, and improper influence on the procurement procedure. Under Estonian law, the checks additionally cover enabling the employment of an unlawfully staying foreign national, the applicability of international sanctions and convictions for tax offences. If a ground for exclusion applies, the ESPD may include a description of remedial measures taken to restore reliability where such an option is applicable.

Qualification criteria and exclusion grounds

The machine-readable notice did not include precise bidder qualification or financial capacity requirements; these must be checked in the tender documents. The tender must include the declaration of participation in the procurement procedure using Annex 5, Form II, and a tender complying with the technical requirements using Annex 1. The proposed software must comply with Regulation (EU) 2017/745 on medical devices (MDR) and have valid CE marking. The bidder must submit a copy of the manufacturer's EU Declaration of Conformity and, where applicable, a copy of the conformity certificate issued by a notified body, clearly identifying the software and its compliance with the applicable requirements. The tender price must be submitted according to the prescribed structure as a total amount in euros excluding VAT; the stated amounts must include all costs and be final for the contracting authority. In the case of a joint tender, a power of attorney for the joint tenderers must be submitted using Annex 5, Form I. The bidder must confirm that the tender complies with the procurement documents and, where necessary, explain equivalence and provide evidence of equivalence.
