Compliance requirements
The bidder must declare whether it or its representatives have relevant convictions, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, and certain tax offences. The grounds also cover unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business or an agreement with creditors; serious professional misconduct; competition-distorting agreements; conflicts of interest or involvement in preparing the procurement that cannot be remedied; significant failures under previous contracts; false or misleading information, omitted information or failure to provide requested documents; and attempts to obtain confidential information or improperly influence the procedure. Certain grounds concern breaches of environmental, social or labour-law obligations. The bidder must also confirm that contract award would not breach international or national sanctions and that it has not committed the specified offences involving unlawful employment of foreign nationals. Where a relevant ground applies, the bidder may describe measures taken to restore its reliability if the applicable rules allow this.
Qualification criteria and exclusion grounds
For all 43 lots, the bidder must hold a pharmaceutical wholesale authorisation issued by the Estonian State Agency of Medicines for operating in Estonia. The contracting authority will verify the authorisation in the Agency’s register. No specific turnover, financial-capacity or previous-experience threshold is stated in the supplied documents.
The bidder must submit the completed participation declaration and the completed technical proposal and unit-price spreadsheet. The spreadsheet must remain in its original format and must not be converted to PDF. The bid must comply with the tender documents; conditional bids are not permitted. If the prices in the evaluation form differ from those in the technical proposal and unit-price spreadsheet, the latter will prevail. The bidder must explain and provide evidence for any claimed equivalence. For a joint bid, the members must appoint an authorised representative and submit their power of attorney.
